Agreement and eligibility

These Terms of Service (“Terms”) are an agreement between you and Wishlisted governing your access to Wishlisted website, web app, mobile apps, newsletters, rewards, and related services (the “Service”). By using the Service, creating an account, or selecting an acceptance control, you agree to these Terms and acknowledge the Privacy Policy.

You must be at least 18 and legally able to enter this agreement. If you use the Service for an organization, you represent that you can bind that organization. If you do not agree, do not use the Service.

What Wishlisted is—and is not

Wishlisted helps people search, discover, organize, compare, watch, and share pre-owned luxury listings and discounted new retail offers across independent marketplaces, brands, retailers, and aggregators. We may normalize titles, currencies, condition language, product attributes, variants, stock, shipping signals, sale details, and comparable offers to make these markets easier to explore.

Each destination store controls its inventory, seller review, authentication claims, product description, pricing, checkout, taxes, duties, shipping, returns, refunds, and disputes. References to a “trusted,” “verified,” or authenticated source describe information or programs supplied by that store; Wishlisted does not independently verify an item or seller.

Accounts and security

Many browsing features do not require an account. Synced saves, follows, alerts, public profiles, rewards, referrals, and certain communications require a verified account. To activate personalized account actions, Wishlisted may ask you to choose a minimum set of merchants to follow. You may change those choices later. Browsing remains available if you close or decline account setup.

Google sign-in and optional Gmail merchant discovery are separate permissions. If Gmail discovery is offered, Wishlisted explains the limited metadata it uses and asks you to connect it separately. You can decline or disconnect it without losing ordinary Google sign-in. If an operator later makes that step part of account activation, the interface will disclose that requirement before authorization; you can still browse without completing personalized setup.

You may not transfer an account, impersonate another person, create deceptive identities, or use multiple accounts to evade program limits. You are responsible for activity performed through your account unless caused by our failure to use reasonable security.

Listings, images, and source information

Catalog information comes from stores, marketplaces, brands, retailers, aggregators, product feeds, affiliate networks, public structured data where permitted, and other source relationships. Product photos and source descriptions belong to their respective owners. We may clean, translate, classify, or summarize factual information without endorsing it.

Inventory changes quickly. A resale listing or retail-sale offer displayed as available may have sold out, changed, or been removed before our next background refresh. Conversely, an unavailable item can remain in a private collection or internal history. Always confirm the item, photographs, condition report where applicable, authenticity coverage, included accessories, available variant and size, return terms, and availability at the destination store.

Retail Sales experience

The Sales area is separate from resale unless the interface clearly says otherwise. It indexes discounted new merchandise from brands, retailers, and retail aggregators. A crossed-out or comparison price, savings amount, and discount percentage come from the merchant’s supplied or displayed price information and are not an independent statement of the item’s ordinary market value.

Sale names, start and end dates, “new to Wishlisted” dates, stock, sizes, colors, materials, variants, and merchant ranking signals may be incomplete or change without notice. A “bestseller” label is used only when supported by a merchant-supplied ranking or clearly identified Wishlisted engagement methodology; it is not a sales-volume guarantee.

Storefronts, assortment, price, currency, promotions, shipping, and eligibility can differ by country. Selecting United States, Canada, or another market changes the catalog context but does not guarantee that a merchant will accept or deliver an order to you. The destination merchant’s current page and checkout control.

If your current plan includes private sources and you add a merchant or aggregator to your private watches, you authorize Wishlisted to use the submitted domain and preferences to look for publicly accessible sale information for you. Do not submit credentials, private links, or a request to bypass access controls. A submission does not guarantee ingestion, coverage, inventory, or alerts. User-added merchants remain private unless Wishlisted separately reviews and enables them for the general catalog. A later plan change may prevent new submissions while retaining your existing request history as described in the Service.

Prices, currency, shipping, and condition

Displayed prices, comparison prices, conversions, “known price,” landed-cost estimates, taxes, duties, shipping eligibility, discounts, comparables, and value trends are informational estimates. Exchange rates may be cached and can differ from card-network or store rates. Taxes and duties depend on facts available only at checkout. A price shown in a selected display currency may differ from the merchant’s original storefront currency.

Condition grades are normalized from source language and photographs, not from a physical inspection by Wishlisted. “Lowest,” “only,” “rare,” “new,” “deal,” and similar labels describe the latest indexed catalog and configured comparison method—not the entire market or an investment value. The store’s checkout and listing page control if anything conflicts.

Hunts, alerts, rankings, and recommendations

Hunts, saved searches, resale and retail keyword watches, merchant-sale alerts, price-drop alerts, scarcity messages, and recommendations are convenience features. They may be late, incomplete, duplicated, unavailable, or affected by source access. An alert does not reserve inventory, guarantee a price, or create an offer.

Recommendation and ranking systems may consider relevance, current availability, destination, known price, condition, source preferences, freshness, taste signals, and catalog quality. Commission eligibility does not determine organic ranking. Sponsored placement, if introduced, will be clearly labeled.

Transactions with stores

Opening a listing sends you to a third-party service governed by its own terms and privacy notice. Your purchase contract is with that store or its seller, not Wishlisted. Direct all payment, authentication, delivery, customs, return, refund, chargeback, and product disputes to the store.

We may help identify the source or provide a record of the link you followed, but that assistance does not make us a party to the transaction or responsible for its outcome. Do not rely on Wishlisted as your only record of a purchase.

Paid and unpaid links

Wishlisted links to stores whether or not they pay us. Some links are affiliate links, meaning a merchant or network may pay Wishlisted a commission after an eligible purchase without increasing the item price solely because you used our link. Other links are unpaid so that selection is not limited to commercial partners.

An outbound link may contain an opaque click or Sub ID for attribution, analytics, rewards, and fraud prevention. Attribution can fail because of cookie settings, another publisher’s link, app-to-web transitions, merchant exclusions, timing, or technical errors.

Cashback rewards

Where offered, cashback is a discretionary promotional benefit funded from commission attributed to Wishlisted. A displayed amount is pending until the merchant or network approves the transaction and applicable return or hold periods finish. The Rewards Center may make an approved reward available after that hold even if the network has not yet remitted its corresponding commission to Wishlisted.

• Start signed in and use the eligible Wishlisted link without removing or replacing its tracking information.
• Only eligible net merchandise and commission reported by the network count. Taxes, shipping, gift cards, excluded products, coupons, returns, cancellations, chargebacks, and merchant adjustments may be excluded.
• Pending or confirmed rewards may be reduced, delayed, declined, or reversed if the commission is not paid or is later reversed.
• Minimums, maximums, commission-sharing percentages, hold periods, payout methods, currencies, and availability appear in the Rewards Center and may vary prospectively.
• You are responsible for taxes associated with rewards and for providing lawful payout information when payouts become available.

If an eligible purchase does not appear, use Contact Us within the missing-cashback claim period shown in the Rewards Center—or promptly after the expected reporting period if no claim period is shown—and provide the merchant, purchase date, order reference, and non-sensitive purchase details requested. We may ask the merchant or network to investigate, but their attribution record and eligibility decision can control whether commission and cashback are available.

No cashback is guaranteed merely because a click or purchase occurred. Payout methods will be identified in the Rewards Center when payouts become available. We will not retroactively reduce an already available reward except to correct fraud, duplication, error, or a merchant/network reversal.

Pending cashback and points are promotional program records, not deposits, purchased stored value, securities, or transferable property. They cannot be sold, transferred, combined between accounts, or redeemed for cash except through a payout method expressly offered in the Rewards Center. Any identity, tax, minimum-balance, jurisdiction, or payout verification requirements will be shown before redemption.

Referral rewards

A referral may qualify when a new participant uses the referral path before or during account creation, creates one account, and completes the qualifying action stated in the Rewards Center—normally a first approved purchase. Existing accounts and referral codes added after unrelated activity may be ineligible. Referral bonuses may have per-user, monthly, lifetime, campaign, geography, and household limits.

You may share a referral link personally, but must not spam, mislead, bid on Wishlisted trademarks, use paid distribution without permission, post it where prohibited, refer yourself, coordinate reciprocal or duplicate accounts, or imply employment or endorsement. We may reject or reverse abusive referrals and suspend related accounts after reasonable review.

Wishlisted may change or end future referral offers, but will honor eligible rewards already earned under the terms shown when the qualifying action occurred, subject to reversals and law.

Profiles, collections, votes, and your content

Profiles and collections are private by default unless you choose to publish them. Public content and shared links can be viewed, copied, reshared, or indexed by others. Do not publish personal information you do not want public.

You retain ownership of content you create. You grant Wishlisted a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute that content only as needed to operate, improve, secure, and, for content you deliberately make public, explain or promote the feature you used. Private content will not be used in public marketing without a separate permission. The license ends when the content is deleted, except for reasonable backups, prior authorized shares, and legal obligations.

You represent that you have the necessary rights and that your content is lawful, accurate in material respects, and not infringing, deceptive, threatening, harassing, hateful, sexually exploitative, graphically violent, invasive of privacy, impersonating, spam, malware, undisclosed paid promotion, counterfeit solicitation, or disclosure of another person’s sensitive information. We may remove content or limit visibility to enforce these Terms. Use Contact Us to report content or conduct that violates these rules.

Acceptable use

You may not:

• break the law, facilitate fraud, manipulate rewards or engagement, or misuse another person’s account or data;
• scrape, crawl, harvest, mirror, bulk download, train models on, or commercially reuse the Service or catalog without written permission;
• bypass access controls, rate limits, robots directives, security measures, or technical restrictions;
• probe vulnerabilities, introduce malware, overload infrastructure, automate abusive requests, or interfere with another user;
• reverse engineer the app except where law expressly permits it despite this restriction; or
• use Wishlisted to build a competing product, merchant intelligence database, or seller-contact list without written authorization.

Ordinary search-engine indexing consistent with our robots rules and approved integrations is permitted.

Intellectual property and brand names

The Service software, design, organization, original editorial content, normalization, taxonomies, taste signals, and Wishlisted marks are owned by or licensed to Wishlisted and protected by law. These Terms provide access, not ownership.

Luxury-house, merchant, marketplace, and product names and marks belong to their owners. Their appearance identifies listings or compatibility and does not imply affiliation, sponsorship, endorsement, or authentication by the brand or by Wishlisted.

If you believe content infringes your rights, contact us with the work, location, your contact information, a good-faith statement, and evidence of authority. We may forward the notice to the source or user involved.

Feedback

If you send product ideas or feedback, you grant Wishlisted a perpetual, worldwide, royalty-free right to use it without restriction or compensation. This does not transfer ownership of your account content, photographs, or private communications.

Beta features, changes, and availability

Pre-launch, beta, demo, and experimental features may contain sample accounts or data, change without notice, or be discontinued. We may add, remove, limit, or modify features and source coverage. We will give reasonable notice when a change materially affects an active paid service or an accrued reward, where practicable and required.

We do not promise uninterrupted operation, perpetual access to a store, or compatibility with every device. Maintenance, security incidents, source restrictions, and events outside reasonable control may interrupt the Service.

Suspension and termination

You may stop using the Service or delete your account at any time. We may restrict or terminate access for material or repeated violations, fraud, security risk, legal requirements, harm to others, or discontinuation of the Service. Where appropriate, we will provide notice and a chance to appeal.

Terms that by nature should survive—such as ownership, transaction boundaries, accrued payment obligations, disclaimers, limitations, and dispute provisions—remain effective after termination. Account deletion is handled under the Privacy Policy.

Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.

We do not warrant any listing, seller, item, authentication, provenance, condition, image, price, value trend, tax or duty estimate, shipping eligibility, recommendation, alert, reward, or third-party service. Nothing in the Service is financial, investment, appraisal, legal, customs, authentication, or professional advice.

Some jurisdictions do not allow certain exclusions. Mandatory warranties and consumer guarantees remain unaffected.

Limitation of liability

To the maximum extent permitted by law, Wishlisted and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, opportunity, or anticipated savings; or a third-party transaction, even if advised of the possibility.

To the maximum extent permitted by law, aggregate liability arising from the Service will not exceed the greater of (a) amounts you paid directly to Wishlisted for the Service during the 12 months before the event or (b) the minimum remedy that applicable law requires. This limit does not apply where liability cannot legally be limited, including for fraud, willful misconduct, certain personal injury, and statutory consumer rights.

Responsibility for misuse

To the extent permitted by law, you will defend and indemnify Wishlisted against third-party claims and reasonable costs arising from your unlawful content, material breach of these Terms, fraud, or misuse of the Service. This does not require you to cover claims caused by Wishlisted’s own breach, negligence, or willful misconduct.

Applicable law and disputes

Contact us first so we can try to resolve a concern informally. Nothing prevents either party from seeking urgent injunctive relief or using a small-claims or consumer process that applies.

The law and forum that apply are determined by applicable law and the location of the legal operator of Wishlisted. Mandatory consumer rights and any right to bring a claim in your home jurisdiction remain unaffected.

These Terms do not require individual arbitration and do not waive rights that cannot lawfully be waived.

General terms and updates

These Terms, the Privacy Policy, the EULA for the mobile app, and any feature-specific terms shown when you participate form the agreement. If feature-specific terms conflict, they control for that feature.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest remains effective. Our delay in enforcement is not a waiver. You may not assign this agreement without consent; Wishlisted may assign it as part of a reorganization or transfer of the Service.

We may update these Terms prospectively. Material changes will receive reasonable notice when required. Continued use after the effective date constitutes acceptance, but changes do not retroactively reduce an available reward or resolve an existing dispute differently without your agreement.
